Key points
- DayRecall works on your devices. We have no user accounts and no servers that receive your audio, transcripts, voiceprint, places or health data, and we cannot access them.
- Speech is turned into text on your iPhone. The audio is cleared automatically once it has been transcribed: DayRecall keeps the text, not the audio.
- Information leaves your devices only when you choose, for example when you use your own cloud API or hand a day to an AI app, or through Apple services you use, such as iCloud Backup.
- No advertising, no analytics, no tracking. We do not sell personal information.
These key points are a summary. The full policy below governs.
1. About this policy
1.1 This Privacy Policy explains how personal information is handled in connection with the DayRecall app for iPhone and Apple Watch (the “App”) and the website at dayrecall.com (the “Website”; together with the App, the “Services”).
1.2 The App is designed to process your information on your own devices. Most of the information described in this policy is never sent to us, and we cannot see it. We describe it so that you know what the App does and what you control. Section 7 sets out the limited information that does reach us.
1.3 This policy should be read together with our Terms of Service.
2. Who is responsible
2.1 The Services are provided by DayRecall (“DayRecall”, “we”, “us” or “our”). For the information described in Section 7, DayRecall is the controller (or personal information handler): we decide why and how that information is processed. You can contact us at support@dayrecall.com.
2.2 Information that the App processes only on your devices, described in Sections 4 and 5, is not collected by us. It remains under your control on your devices, and we have no access to it.
3. Definitions
In this policy:
- “personal information” means any information relating to an identified or identifiable natural person, and includes “personal data” as defined by applicable law;
- “your devices” means the iPhone and Apple Watch on which you use the App;
- “listening hours” means the times you choose for the App to listen;
- “transcript” means the text the App produces from speech;
- “voiceprint” means a set of numbers derived from your voice that the App uses to recognise you as a speaker; it is not an audio recording;
- “health data” means the sleep, steps, walking distance, workouts, heart rate and resting heart rate that the App reads from the Health app on your iPhone, if you turn that on (Section 4.9);
- “third-party service” means a product or service that we do not operate, such as Apple’s services, a cloud service you connect, or another app you share content with.
4. Information processed on your devices
The App processes the following information on your devices, only to provide the features you use. Unless Section 6 says otherwise, it stays on your devices.
4.1 Audio and speech
(a) During your listening hours, the App uses the microphone of your Apple Watch or iPhone. An on-device speech-detection model keeps only the parts in which someone is speaking; other sound is discarded. Speech segments are held temporarily in compressed form and passed from Apple Watch to iPhone over Apple’s connection between the two devices, about every two hours and when listening stops. Each segment is deleted from Apple Watch once your iPhone confirms that it has arrived.
(b) On your iPhone, each segment is transcribed on the device using Apple’s speech recognition. The audio is deleted automatically once its transcript has been saved. If transcription of a segment fails, its audio is kept on your iPhone so that transcription can be retried, until it succeeds or you delete the recording. The same applies when you record with your iPhone and to audio files you import; for an imported file, the App works on its own copy.
(c) If you turn on Stand by to take over, your iPhone’s microphone stays active during your listening hours so that your iPhone can take over at once if your Apple Watch stops. Nothing is kept while it is standing by.
(d) Settings › Developer options contains a switch, Keep audio after transcription, which is off by default and intended for testing. While it is on, new recordings keep their audio on your iPhone, where you can play or export it, until you delete the recording or choose Delete kept audio.
4.2 Transcripts and information derived from them
The App stores on your iPhone:
- transcripts, with the time each part was said and the device that heard it;
- the to-dos, deadlines and meetings the App identifies in them, and what you did with each;
- a search index of your transcripts; and
- your settings, such as your listening hours.
4.3 Questions and answers
When you ask about your day, the App answers with Apple’s on-device model, part of Apple Intelligence, unless you choose your own cloud API (Section 6.2). The App also uses that on-device model to identify to-dos, deadlines and meetings. Your questions and the answers are not saved; they exist only while the App is running.
4.4 Voiceprint (optional)
(a) If you turn on Mark who is speaking, the App asks you to read five short cards aloud, about a minute in total, and creates your voiceprint from that recording on your iPhone. The recording is deleted as soon as the voiceprint has been created. Your voiceprint is stored only on that iPhone. It is never sent to us or to anyone else, and it is excluded from backups and iCloud.
(b) To tell speakers apart, the App compares the voices in a conversation with your voiceprint while it processes that conversation. It keeps no voiceprint of anyone else. Other speakers are labelled Other 1, Other 2 and so on, and the numbering starts again in each conversation.
(c) A voiceprint is biometric information, which many laws treat as sensitive. The App creates one only after you turn the feature on and complete the recording. You can delete it at any time with Delete my voice. If you do not use this feature, the rest of the App works normally; it simply does not mark who is speaking.
4.5 Places (optional)
Places are off until you turn on Show the day on a map in Settings › Places and allow location access when iOS asks. If you allow access Always, places can be noted while the App is closed. The App records the places where you stay (times of arrival and departure, coordinates and a place name) and keeps them on your iPhone. To name places and draw maps, the App uses Apple Maps (Section 6.1).
4.6 Calendar and Reminders (optional)
(a) Nothing is added to your calendar or Reminders until you confirm it. An event you confirm opens in the iOS New Event screen. Events from your weekly plan are added once you allow the App to add events.
(b) If you turn on Add confirmed to-dos to Reminders (off by default), to-dos you confirm are added to Reminders and are marked complete there when you complete them in the App.
(c) If you turn on Name the timeline after meetings (off by default), the App reads the names of your calendar events on your iPhone to label parts of your day. The names are not sent anywhere.
4.7 Notifications
Notifications, such as the evening list of items to confirm and reminders of due to-dos, are scheduled on your iPhone and Apple Watch, with no server of ours involved. You can turn each kind on or off in Settings › Notifications.
4.8 Diagnostic logs
To help fix problems, the App keeps a log on your iPhone and Apple Watch of what it did, such as counts, durations, settings and errors. The log does not contain what was said, your questions or answers, names, places or calendar titles. When the App crashes or stops responding, iOS reports this to the App afterwards, and the report is added to the same log. Logs are kept for up to 14 days and are excluded from backups. A log leaves your iPhone only if you share it yourself, from Settings › Developer options › Logs › Share log.
4.9 Health data (optional)
(a) Reading health data is off until you turn on Show sleep, activity and heart rate in Settings › Health and allow access when iOS asks. Only then does the App read the following from the Health app on your iPhone, through Apple’s HealthKit, whichever device or app recorded it: sleep, steps and walking distance, workouts, heart rate and resting heart rate. The App reads only the kinds you allow. It only reads from Health and never writes to it.
(b) The App uses health data for two purposes only. The first is to show on your day’s timeline whether you were asleep, walking or working out during a part of the day, or had a heart rate faster than usual, with the numbers behind it, such as your heart rate, on that part’s detail page. The second is, when you ask what was said during an activity, such as “What did I say while I was running?” or “What did we talk about before bed?”, to find the times you mean.
(c) The App does not store health data. It reads it from Health again each time a day is shown or a question needs it, and processes it only on your iPhone. It is not sent to us or to any third party. The App’s diagnostic log (Section 4.8) records how many items were read, never what they were.
(d) Health data is not included when you hand a day to another app (Section 6.3), and it is not sent with your questions to your own cloud API (Section 6.2). When you ask about what was said during an activity, the App uses health data only to choose which times to search. What is sent under Section 6.2 is still your question and short excerpts of your transcripts, which may come from those times.
(e) We do not use health data for advertising, marketing or data mining. The App draws no medical conclusions and gives no health advice: it states only what the data shows, for example that your heart rate was faster than usual.
(f) Health data is health information, which many laws treat as sensitive. The App reads it only after you turn the feature on and allow access. You can turn the feature off at any time in Settings › Health, or withdraw the App’s access in the iPhone Settings app (Health › Data Access & Devices). If you do not use this feature, the rest of the App works normally; it simply does not show what you were doing or find what was said during an activity.
5. Device permissions
The App asks for the following permissions only when a feature you use needs them. You can grant or withdraw each one at any time in the iPhone Settings app. Withdrawing a permission does not affect processing that took place before.
| Permission | What it is used for | If you do not allow it |
|---|---|---|
| Microphone (iPhone and Apple Watch) | Listening during your listening hours, and recording your voice for Mark who is speaking | That device cannot listen |
| Speech recognition (iPhone) | Turning speech into text on the device | Speech cannot be turned into text |
| Location (iPhone) | Places, if you turn them on; Always allows places to be noted while the App is closed | Places stay off; everything else works |
| Calendars (iPhone) | Adding events you confirm; with full access, showing meeting names on your timeline | You can still add events through the iOS New Event screen; meeting names are not shown |
| Reminders (iPhone) | Adding the to-dos you confirm, if you turn this on | To-dos stay in the App |
| Notifications (iPhone and Apple Watch) | Lists of items to confirm and reminders of due to-dos | You receive no notifications |
| Health (iPhone) | Reading sleep, steps and walking distance, workouts, heart rate and resting heart rate, if you turn this on; you choose which kinds to allow | Those kinds are not read; everything else works |
6. When information leaves your devices
Information processed by the App leaves your devices only in the cases below. In each case it goes to a third-party service, not to us, unless Section 7 says otherwise.
6.1 Apple services
- Backups. If you use iCloud Backup or back up your iPhone to a computer, iOS includes the App’s data in the backup: transcripts, to-dos, places and any audio still on your iPhone. Your voiceprint and the App’s logs are excluded. Backups are made and stored by Apple or on your computer, under their terms; we have no access to them.
- Apple Maps. If you use Places, Apple receives the locations the App looks up and displays, under Apple’s Privacy Policy.
- System features. Speech recognition, Apple Intelligence and translation run on your iPhone. iOS may download the language resources they need from Apple.
- Calendar and Reminders. Events and reminders you add are kept and synced by Calendar and Reminders with the accounts you have set up on your iPhone, such as iCloud, Google or Outlook.
- App analytics. If you have turned on Share With App Developers in the iPhone Settings app (Privacy & Security › Analytics & Improvements), Apple shares crash reports and usage statistics about the App with us (Section 7).
6.2 Your own cloud API (optional)
(a) In Settings › Answer with, you can choose My own API: an OpenAI-compatible service of your choice, used with your own key. Before anything is sent, the App shows you what will be sent to that address and asks for your permission. If you change the address, it asks again.
(b) After that, each question you ask sends the service your question and, for a question about your day, the current date, time and time zone and short excerpts of your transcripts that match the question (up to about 12,000 characters), each with the date and time it was recorded and the device that heard it.
(c) The App never sends audio, your whole library, your voiceprint, your places or your health data, and it sends nothing while you are not asking. Test connection sends one fixed test message that contains none of your information. Your key is stored in the iOS Keychain on your iPhone.
(d) The service you choose processes what it receives under its own terms and privacy policy, and may store it. Choose a service you trust with what you record, including what other people said. You can stop at any time with Stop sharing with … in the same place, and answers return to your iPhone.
6.3 Handing a day to another app
(a) Hand the day to an AI app creates a text file of a day: what was said and when, the Me and Other labels if you mark who is speaking, places if you have turned them on, and the question you choose. You decide where it goes, through the iOS share sheet, or you can copy it. The App sends nothing by itself; the app you choose handles the file under its own terms.
(b) In the Shortcuts app, Hand today to an AI copies today’s conversations to your iPhone’s clipboard only, not to your other devices, and the copy is cleared after one hour. Bring the AI’s answer back reads the clipboard only when you run it and allow pasting, and keeps only the to-dos it finds there for you to confirm, not the answer itself.
6.4 Logs you share
A log you share goes where you send it. If you send it to us, Section 7 applies.
7. Information we receive
We receive personal information only in the following cases:
- When you contact us. If you write to us, we receive your email address, your name if you include it, the content of your message and any attachments, such as a log or screenshots.
- Beta testing. If you test the App through Apple’s TestFlight, Apple shares with us crash logs and usage information, such as installs, sessions and crashes, your device model and system version. If you were invited by email, we also see your name and email address. Feedback and screenshots you send through TestFlight come to us. Apple describes this in TestFlight & Privacy.
- Apple analytics. If you have turned on Share With App Developers, Apple shares crash reports and usage statistics about the App with us. App Store Connect also gives us aggregated statistics, such as numbers of downloads, that do not identify you.
- Purchases. Any purchase made through the App Store is processed by Apple. We do not receive your payment card details.
We do not otherwise collect personal information through the App. You are not required to provide personal information to us: if you do not contact us or take part in beta testing, we receive none.
The Website. dayrecall.com uses no cookies, no analytics and no third-party scripts or fonts, and we receive no information about its visitors. The Website is hosted on GitHub Pages. GitHub logs visitors’ IP addresses for security purposes, as described in GitHub’s documentation, and processes them under the GitHub Privacy Statement.
8. How we use it and our legal bases
8.1 We use the information described in Section 7 only:
- to answer your messages and provide support, on the basis of performing our agreement with you or taking steps at your request, and of our legitimate interest in helping the people who use the Services;
- to diagnose and fix problems and to improve the App, using logs and feedback you send us, TestFlight information and Apple analytics, on the basis of our legitimate interest in providing a reliable app and, where you chose to send us information, your consent; and
- to comply with legal obligations and to establish, exercise or defend legal claims, on the basis of legal obligation and our legitimate interests.
8.2 We do not use personal information for advertising. We do not sell it, and we do not share it for cross-context behavioural advertising. We do not make decisions about you based solely on automated processing that produce legal or similarly significant effects.
8.3 Where we rely on your consent, you can withdraw it at any time; withdrawal does not affect processing before it. Where we rely on legitimate interests, you can object (Section 13).
9. Disclosure
9.1 We disclose the information we receive only:
- to service providers that act on our behalf, such as our email provider, under terms that require them to protect it;
- where required by law, regulation, legal process or an enforceable request from a public authority;
- where necessary to protect the rights, property or safety of you, us or others; or
- as part of a merger, acquisition, financing or sale of all or part of our business, in which case the recipient must continue to protect the information as this policy describes, and we will notify you where the law requires.
9.2 Apple provides TestFlight, App Store Connect and its analytics independently, under its own terms.
10. International transfers
We and our service providers may process the information described in Section 7 in countries other than the one where you live, including the United States, whose data protection laws may differ from yours. Where the law requires, we put appropriate safeguards in place for such transfers, such as standard contractual clauses approved by the European Commission or the United Kingdom. Section 14.3 applies to personal information from mainland China. Information that the App processes only on your devices is not transferred by us.
11. Retention
- Audio is deleted automatically once it has been transcribed. If transcription fails, it is kept until transcription succeeds or you delete the recording. While Keep audio after transcription is on, it is kept until you delete it. Speech segments on Apple Watch are deleted once your iPhone confirms that they have arrived.
- Transcripts, to-dos, places and settings stay on your iPhone until you delete them or the App. Copies in backups remain until those backups are replaced or deleted.
- Your voiceprint stays on your iPhone until you delete it or the App.
- Questions and answers are not kept once the App stops running.
- Health data is not kept by the App: it is read from Health again each time it is needed.
- Logs are kept on your devices for up to 14 days.
- The copy made by Hand today to an AI is cleared from the clipboard after one hour.
- Information we receive is kept only as long as necessary for the purpose for which we received it, such as resolving your request, and is then deleted, unless the law requires us to keep it longer. You can ask us to delete it sooner. TestFlight information and analytics are retained by Apple under its own policies.
12. Security
12.1 The App protects its data on your iPhone with iOS Data Protection, so its files cannot be read until your iPhone has been unlocked after it starts, and it stores your API key in the iOS Keychain. Because the App does not send your content to us, that content cannot be exposed through our systems.
12.2 We protect the information we receive with reasonable technical and organisational measures. No method of storage or transmission is completely secure, so please protect your devices with a passcode and keep their software up to date. If a security incident affects personal information we hold, we will notify you and the relevant authorities as the law requires.
13. Your rights and choices
13.1 Controls in the App
- Delete a recording, with its transcript and to-dos: Delete recording on the recording’s page.
- Delete everything the App holds on your iPhone, including recordings, transcripts, to-dos, places and the search index: Settings › Privacy › Delete all memories.
- Delete your voiceprint: Delete my voice.
- Get a copy of a day: Hand the day to an AI app creates a text file, which you can also save from the share sheet.
- Stop places, meeting names or Reminders: turn the feature off in Settings, or withdraw the permission in the iPhone Settings app.
- Stop reading health data: turn the feature off in Settings › Health, or withdraw the permission in the iPhone Settings app (Health › Data Access & Devices).
- Stop using your own cloud API: Stop sharing with …; remove your key with Remove saved key.
- Delete the App from your iPhone and Apple Watch: this removes what it stored on them. Copies in earlier backups remain until those backups are replaced or deleted. iOS may keep a saved API key in the Keychain after the App is deleted, so remove the key first.
13.2 Your legal rights
(a) Depending on where you live, you may have the right to access the personal information we hold about you and receive a copy of it, to have it corrected or deleted, to restrict or object to its processing, to receive it in a portable format, to withdraw your consent, and to ask us to explain how we process it. You also have the right to lodge a complaint with a data protection authority.
(b) Because most information stays on your devices, you can exercise these rights over it directly in the App, as described in Section 13.1. We cannot access, retrieve or delete information on your devices or in your backups.
(c) For information we hold, write to support@dayrecall.com. We may need to verify your identity before acting on a request. We will respond within the time required by applicable law, and we will not discriminate against you for exercising your rights.
14. Information for certain regions
14.1 European Economic Area, United Kingdom and Switzerland
Our legal bases for processing the information we receive are set out in Section 8. You may lodge a complaint with the data protection authority where you live or work, or where you believe an infringement occurred. Your voiceprint (Section 4.4) and, if you turn it on, your health data (Section 4.9) are processed only on your device, at your explicit request, and are never received by us.
14.2 United States
In the past 12 months we have received only the categories of personal information described in Section 7: identifiers, such as your name and email address if you contact us or are invited to TestFlight; the content of your messages; and device and diagnostic information, such as crash logs. We received them from you and from Apple, and use them for the purposes in Section 8. We do not sell or share personal information, as those terms are defined in California law, and we do not use or disclose sensitive personal information for purposes that would give you a right to limit it. Depending on your state, you may ask to know, access, correct or delete the personal information we hold about you, yourself or through an authorised agent, by writing to support@dayrecall.com.
14.3 Mainland China
(a) DayRecall is the personal information handler for the information described in Section 7, and can be contacted at support@dayrecall.com.
(b) The App processes the following sensitive personal information only on your device and only with your separate consent, which you give when you turn the feature on: your voiceprint (biometric information), used to mark which lines you said; the places where you stay (location tracks), used to show your day on a map; and your health data (health information), used to show what you were doing during your day. They are necessary only for those features, and if you do not turn the features on, the rest of the App works normally. Because they are never sent to us, we do not provide them to anyone or transfer them outside mainland China.
(c) If you contact us or take part in beta testing, the information described in Section 7 is processed by our email provider and by Apple, which may store it outside mainland China, for the purposes in Section 8. By choosing to send it to us, you separately consent to that transfer. You can exercise your rights over it by writing to us.
15. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from them. You must be at least 13 to use the App. If you are under the age at which you can consent to the processing of your personal information where you live, for example under 14 in mainland China or under 16 in some countries of the European Union, you may use the App only with the consent of your parent or guardian. If you believe a child has sent us personal information without the required consent, contact us and we will delete it.
16. Recording other people
16.1 The App captures what is said by the people around you. Their speech becomes transcripts on your devices, and we do not receive it.
16.2 Laws on recording conversations and on privacy differ between places, and some require the consent of everyone taking part, even when only text is kept. You are responsible for telling the people you talk with that DayRecall is listening, for obtaining any consent the law requires, and for how you use and share their words. If you use the App beyond purely personal or household activities, for example at work, data protection law may make you responsible for the personal information of the people you record.
17. Third-party services
The Services work with third-party services, including Apple’s services, any cloud service you connect, apps you share content with, and GitHub, which hosts the Website. Their handling of personal information is governed by their own terms and privacy policies, such as Apple’s Privacy Policy, and we are not responsible for them.
18. Changes to this policy
We may update this policy from time to time. We will publish the updated version on this page with a new effective date. If a change materially affects how personal information is handled, we will give notice in the App or on the Website before it takes effect and, where the law requires, ask for your consent.
19. Contact us
For questions, requests or complaints about privacy, contact DayRecall at support@dayrecall.com.
